Your use of this website indicates your acceptance of these terms & conditions. Do not use this website if you do not agree to be bound by these terms. We may periodically change the terms, so please check them from time to time as your continued use of the website signifies your acceptance of any updated items.

We make every reasonable effort to provide accurate and timely information about FishEx/ FishEx.com, on this website. You should not assume that the information provided is always up to date or that this site contains all the relevant information available about FishEx.

COPYRIGHT AND TRADEMARK

Unless otherwise noted, all materials on this website are protected as the copyrights, trade dress, trademarks and/or other intellectual properties owned by said companies and/or their subsidiaries and affiliates or by other parties that have licensed their material to all said companies. FishEx does in no way imply affiliation with any represented companies, trademarks, copyrights or trade dress that may be represented on this site. Use of the materials on this site is for informational and shopping purposes only for customers of FishEx. FishEx is not sponsored by and is not affiliated with any manufacturers featured on this site.

PERSONAL USE

Your use of the materials included on this website is for informational and, or shopping purposes only. You agree you will not distribute, publish, transmit, modify, display or create derivative works from or exploit the contents of this site in any way. You agree to indemnify, defend and hold harmless FishEx for any and all unauthorized uses you may make of any material on the website. You acknowledge the unauthorized use of the contents could cause irreparable harm to FishEx and that in the event of an unauthorized use; FishEx and/or their authorized entities shall be entitled to an injunction in addition to any other remedies available at law or in equity.

RETURNS

Due to the fact that we sell perishable food, we do not accept returns, and all sales are final. Under certain circumstances, we may require the return of items for inspection purposes. We will provide refunds, or re-ship orders under certain circumstances. We will evaluate each request based on the information you provide.

LATE PACKAGES

Although it is not an exact science, we do our best to pack orders for 2 days transit time (even though we ship via overnight service).

All shipping charges are non-refundable.

If there is any dry ice, wet ice, or even frost inside the package then it is in the food-temperature "safe zone" (below 38 degrees Fahrenheit), and it is safe to eat. (You can check this yourself if you have a thermometer.) If not, then take a photo or video for documentation purposes, and contact us right away. If outside of the safe zone, do not consume the seafood, and contact us right away. If you are unsure, then contact us, and do not consume the seafood.

FishEx reserves the right, under certain circumstances, and at our sole discretion, to delay the shipping of your order, in the event of adverse local or national weather conditions. If this happens, we will notify you of the delay, and attempt to coordinate with you for an alternative delivery date which works for you. Under these circumstances, if we receive your request in time, you may request that we ship your order on the originally scheduled ship date, but you will assume all of the risks of potential spoilage due to weather delays.

STOLEN PACKAGES

FishEx is not responsible for any theft that occurs after the package is delivered. Packages greater then $500 in value must be signed for when they are delivered. If you have any concerns about a package (with a value of less than $500) being left on your porch or doorstep, may we suggest instead to have it delivered to your work place.

FedEx now offers secure deliveries to your local Walgreens if you are not available to receive your package at home.

REFUNDS/ RE-SHIPS & MISSED DELIVERIES

We will issue you store credit, reship your order at no cost, or issue a refund or partial refund, at our discretion, if:

  • The outer packaging arrives with visible damage to the outside and the contents inside are also damaged.
  • The package was delayed by a day or more and the contents arrived in a compromised condition.
  • The package never arrives.

Please note that store credit, reshipments, or refunds will only be considered once a package is declared either "Delivered" or "Lost-In-Transit" by FedEx. If a customer refuses a package, or disposes of its contents, no compensation can be given. Photographic, or video evidence, or the return of the package including all of its contents may be required.

FishEx will process all refunds and cancellations within 7 to 14 business days upon receipt of returned product (non-perishable only) or notification of cancellation, providing that the cancellation was enacted at least 2 business days prior to the chosen delivery date. Any refund or re-shipment requests must be made within 90 days of the order's selected delivery date. Once a refund is processed by FishEx with the credit card company/ PayPal or via check, the time for the funds to return to the customer is dictated by the terms and agreements of the refund method. For example, Credit cards may take up to 30 days to return funds to the customer, checks are via the US Postal service and PayPal refunds are subject to PayPal's terms and agreements.

Store credit is not refundable, or convertible to a cash payment.

Orders with a value greater than $500 will require your signature upon delivery. Please make arrangements to be home to receive and sign for your high-value package. FishEx is not responsible for any losses which result from a customer's failure to be home and available to receive their shipment on the day that the delivery has been scheduled.

FishEx is not responsible for damage to crab legs such as breakage, which might occur during shipping, or when being handled by the shipping carrier. FishEx does occasionally offer broken crab legs, sold at a discount, when available.

ORDER CHANGES

Order changes will result in a one-day delay to your selected delivery date. Please email us with your requested changes at customerservice@fishex.com.

If your change request involves adding to your order quantity, please call us at 888-926-3474.

FRAUDULENT ORDERS

We reserve the right to refuse shipment of orders that we, at our sole discretion, consider to be potentially fraudulent, or at a heightened risk of being fraudulent. If deemed potentially fraudulent, the purchaser will be notified & payment will be refunded.

SHIPPING CHARGES

Please confirm your delivery address information. Incorrect/ invalid addresses, missing apartment or suite numbers, missing floor numbers, or transposed numbers in the zip code may result in a delayed delivery, or non-delivery. You are responsible for providing correct email & physical addresses, and phone numbers. Any losses arising from incorrect addresses are fully and completely your responsibility, and FishEx shall incur no liability or loss as a result. If an address correction is made to an order, you will be liable for a $20.00 Address Correction Charge.

PACKAGE INTERCEPT REQUESTS

Once your package has shipped please contact us if you need to change the address or have it delivered elsewhere. There is a $20.00 package intercept fee that will be collected prior to the address change.

MOBILE TERMS OF SERVICE

The FishEx mobile message service (the "Service") is operated by FishEx (“FishEx”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to FishEx’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of FishEx through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, information, and delivery notifications (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, sales, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with FishEx. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18556932806 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other FishEx mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

FEEDBACK AND SUBMISSIONS

You agree that you are and shall remain solely responsible for the contents of any submissions you make, and you will not submit material that is unlawful, defamatory, abusive or obscene. You agree that you will not submit anything to the website that will violate any right of any third party, including copyright, trademark, privacy or other personal or proprietary right(s).

We do not want and cannot accept any ideas you consider to be proprietary regarding designs, product technology or other suggestions you may have developed. Consequently, any material you submit to this site will be deemed a grant of a royalty free non-exclusive right and license to use, reproduce, modify, display, transmit, adapt, publish, translate, create derivative works from and distribute these materials throughout the universe in any medium and through any methods of distribution, transmission and display whether now known or hereafter devised. In addition, you warrant that all so-called "moral rights" have been waived.
